The County of Benton was created in 1835 from
Henry which was created in 1821 from Western District Tennessee and of
Humphreys which was created in 1809 from Steward and Smith Counties.
Steward in 1803 from Montgomery which was from Tennessee in 1796 and Smith
from Sumner in 1799 and Sumner from Davidson in 1783 from Washington that
covered the present State of Tennessee in 1777. The county
seat is located in Camden, TN. The State of Tennessee was created
in 1796..

his wife Jane with their daughter Elizabeth, son Boling/Bolen TOTTY and

Notes: JT] J.E. is James E. TOTTY.
He is the son of William W. and is listed in the 1850 Hickman Co. Census
as 18 yrs old. He married Louisa Hawley Sept.10, 1857. She died in April
1860 and is listed in the mortality Census for Benton Co. Tn. He is listed
living alone in the 1860 census of Benton Co. There is a Dennis
Totty age 30 living nearby also alone and W.W. and Jane are also in Benton
Co. He married Lucinda Williams Feb 9, 1861 Evidently Lucinda
died shortly after for James married Josie Curd Hope, widow of Pleasant
Hope, April 14, 1873 in Carroll Co. Tn. They were enumerated in Benton
Co. in 1880. Additional Note: BTM] Also Need full
transcription of this record including HH's, and place born etc..

E TOTTY & Wife Deed to Elizabeth Capligner: I J E TOTTY
have this day bargained and Sold unto Elizabeth Capligner for the consideration
of Ninety five dollars due by note this day Executed to me by Elizabeth
Capligner and R K George and J B Caplinger witness to said note due the
25th day of December 1874 and dated this 21st day of February 1874 and
retaining a lien on the land until Said note of ninety five dollars is
paid on certain tract or parcel of land containing by estimation Eighty
six acres be the same more or less in Civil District No 5 County of Benton
and State of Tennessee and bounded as follows Viz: Beginning at a three
pronged White oak on the south boundry line of Lany Paffords land and runs
East 86 poles to a Spanish Oak with 2 Red oak pointers thence South 160
poles to a post Oak with post Oak pointers Thence West 86 poles to a Stake
with hickory and black Oak pointers thence South 160 poles to the Beginning
to have and to hold the Same to the Said Elizabeth Capligner her heirs
and assigns forever I do Covenant with the said Elizabeth Capligner That
I am lawfully Seized of said land and have a good right to convey it and
That the same is unencumbered and will warrant and forever defend the title
of said land to the said Elizabeth Capligner against the lawful claims
of all persons what ever in testimony Whereof I have hereunto set my hand
and seal This Feb 21st 1874.

Notes: Above deed used with permission
of Jean Stringham who adds: The Elizabeth CAPLINGER referred
to here, I believe, is Rebecca Elizabeth (or Sarah or Sally) KIRBY who
married King Hiram CAPLINGER. As the deed was established in 1874,
King Hiram had passed on in 1864, and their daughter Elizabeth was born
1835, md 1856 Tom MAYNARD and died in 1911. Rebecca Elizabeth was
born in 1810KY and died 1878 in Shannon, Terresita Co., MO, but is buried
in Benton Co, TN on land once owned by her son-in-law Robert King GEORGE.
I have not been able to establish why she was buying land in 1874, as it
was my understanding from oral family history that she had gone to MO after
K.H.'s death.

son of William W. TOTTY and his wife Jane? Any help appreciated
on identifying this J. E. TOTTY of Benton Co., TN.
